Terms of Use

Effective date: 29 October 2026

1. About these terms

These terms ("Terms") govern your use of the website at ddi.dullugroup.co.ke (the "Website"), operated by Ian Dullu Jillo, trading as Dullu Group Enterprises (a sole proprietor) of Kilifi, Kenya ("DDi", "we", "us"). By using the Website you agree to these Terms. If you do not agree, do not use it.

The Website describes our services and lets you send an enquiry. Work for a client is done under a separate written Service Agreement that the client signs. If these Terms and a signed Service Agreement differ, the Service Agreement applies to the work.

2. Who can use the Website

You must be at least 18 years old to send an enquiry. If you use the Website for a business, you confirm you have authority to act for that business.

3. Prices and enquiries

Prices on the Website are in Kenya Shillings (KES), are fixed package prices and exclude VAT unless an invoice says otherwise. Advertising spend is separate and is paid by you directly to the advertising platform. Sending an enquiry does not create a contract and does not oblige you or us to proceed. A contract forms only when you sign a Service Agreement. Formation of contracts by electronic means is valid: a contract is not denied validity or enforceability solely because electronic messages or signatures were used (Kenya Information and Communications Act, ss. 83J, 83P).

Examples of lead numbers, dashboards and reports shown on the Website are illustrations and are labelled as such. They are not promises of results.

4. Your consumer rights are not affected

The Constitution of Kenya, Art. 46, and the Consumer Protection Act (Cap. 501) give consumers rights, including fair and honest dealing, adequate information and fair contract terms. Nothing in these Terms excludes or limits a right or remedy you have under those laws. If a part of these Terms conflicts with a mandatory consumer protection, that protection applies.

5. Acceptable use

You will not: break any law; infringe anyone's rights; upload malicious code; attempt to breach the security of the Website or our systems; scrape or overload the Website; send false or abusive enquiries; or use the Website to send unsolicited marketing. Unauthorised access to computer systems and data is an offence under Kenyan law (Computer Misuse and Cybercrimes Act, 2018).

6. Content and intellectual property

The Website's text, design, software and branding belong to us or our licensors. You may view the Website and share links to it. You may not copy or resell its content without our written permission. What you send us in an enquiry stays yours, and you allow us to use it to answer you and prepare a proposal.

7. Personal data

We process personal data as explained in our Privacy Policy and Cookie Notice, in line with the Data Protection Act, 2019.

8. Availability and changes

We aim to keep the Website available but do not promise uninterrupted access. We may change or remove content and features at any time.

9. Our responsibility to you

We provide the Website with reasonable skill and care. We are responsible for foreseeable loss or damage we cause, and for anything the law says we cannot exclude (see section 4). Subject to that, and to the extent the law allows, we are not responsible for loss that was not reasonably foreseeable, or for business losses arising from your use of the Website, and our total liability for anything arising from your use of the Website is limited to KES 10,000. This does not limit or replace the liability terms of a signed Service Agreement.

10. Disputes

Governing law: the laws of the Republic of Kenya. Resolution: before filing suit, the parties attempt good-faith negotiation for 14 days, then mediation under the Nairobi Centre for International Arbitration mediation rules. Kenya's courts are required to promote alternative dispute resolution (Constitution Art. 159(2)(c)). Subject to that, the courts of Kenya at Nairobi have jurisdiction.

Nothing in this section limits your right to go to the Office of the Data Protection Commissioner, another regulator, or a court with mandatory jurisdiction.
